Intellectual Property

The Site and all the materials available on the Site are the property of us and/or our affiliates or licensors, and are protected by copyright, trademark, and other intellectual property laws. You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us. Upon purchasing any of the programs, you will receive one single copy of the program. The programs and services provided are solely for your personal, non-commercial use. You may not use the programs, or the materials available in the programs, in a manner that constitutes an infringement of our rights or that has not been authorized by us. Unless otherwise expressly authorized by us in writing, you agree not to copy, modify, duplicate, reproduce, republish, upload, post, transmit, translate, sell, resell, create derivative works, exploit, or distribute in any manner or medium (including by email or other electronic means) any material or information from the programs or the Site. 

We remain the sole owner of all rights, titles, and interest of our programs and services. Except as stated in these terms, we do not grant you any rights to patents, copyrights, trade secrets, trademarks, or any other rights in respect to our programs and services. We reserve all rights not granted under these Terms. 

Subject to your compliance with these terms and applicable law, you may access and use the programs and services that we make available to you upon purchase. You agree that your decision to purchase our programs or services is not contingent on the delivery of any future modifications or features, or dependent on any oral or written public comments made by us regarding future modifications or features.

Programs and Services 

The programs and services offered by NUU GLO under these Terms of Service are delivered online or in person. Any new features or tools added to the current programs or services are also subject to these Terms of Service. 

You must be older than 18 years of age, or at least the age of majority in the jurisdiction where you reside and from which you use NUU GLO’s programs and services. You must read, agree, and accept all of the terms and conditions contained or expressly referenced in these Terms of Service, including NUU GLO’s Privacy Policy, before you purchase any of NUU GLO’s programs or services. Where required by applicable law, we may ask children under the age of 18 years old for consent from their parents or guardians before we provide a program or service to them.

NUU GLO Rights

We reserve the right to:

1. modify or terminate our programs or services for any reason, without notice at any time; 

2. refuse service to anyone for any reason at any time;

3. refuse any order you place with us for any reason at any time. We may exercise this right on a case-by-case basis;

4. limit the quantities of our programs and services sold and we are under no obligation to make our programs or services available in any jurisdiction. In the event that we make a change to, or cancel an order, we may attempt to notify you by using the email, billing address and/or telephone number you provided at the time the order was made; and

5. limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

Descriptions and prices of our programs and services are subject to change at any time without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or termination of our programs or services.

We do not guarantee that the quality of our programs, services, information or other materials purchased or obtained by you will meet your expectations, or that any errors in the programs or services will be corrected. 

Accuracy of the Site and Program Information

The material on the Site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. If the information made available on the Site or in our programs or services is not accurate, complete or current, it is not our responsibility. Any reliance on, or use of the material on the Site or in the programs is at your own risk.

The Site and the programs may contain historical information, which may not be current and is provided for your reference only. We reserve the right to modify the contents of the Site and the programs at any time, but we are not obligated to update any information on the Site or the programs. You agree that it is your responsibility to monitor changes to the Site.

Accuracy of Billing Information

You agree to provide true, current, complete, and accurate account information for all purchases made at our online shop. You agree to promptly notify us of any changes to this information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your purchase and refuse any and all current or future use of the Site and the programs and/or services.

Third-Party Links

The Site may contain certain third-party links to information, products or services. These third-party links may direct you to third-party websites that are not affiliated with us. We are not responsible for inspecting the content of third-party websites for accuracy. We do not warrant and we will not be responsible for any third-party information or websites, or for any other information, products or services of third-parties.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content or any other transactions made in connection with any third-party websites. We encourage you to read the third-party’s terms, policies, and privacy practices to make sure you understand them before you make a purchase or engage in any transaction. Complaints, claims, concerns or questions regarding third-party products and services should be directed to the third-party.

User Comments and Prohibited Uses 

If you send us specific submissions (for example a testimonial from using our programs or services) with or without a request from us, whether online, by email, post or otherwise, you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium, any comments that you forward to us. Specific submissions include, but not limited to testimonials, creative ideas, suggestions, proposals, plans, and other materials. We are and shall be under no obligation to maintain any comments in confidence; to pay compensation for any comments; or to respond to any comments.

We reserve the right, but not the obligation, to monitor, edit or remove comments, or any other content posted on the Site, in our sole discretion at any time, for any reason, and without providing any notice. You agree that, when using or accessing the Site, or any of the Site’s features, you will not: 

1. post any comments or content that is unlawful, harmful, offensive, abusive, threatening, vulgar, fraudulent, violent, hateful, libelous, defamatory, pornographic, obscene or otherwise objectionable content or material;

2. transmit or introduce any computer virus, cancel bots, Trojan horses, malware or any other harmful code or processes;

3. infringe or violate our rights or the rights of any third party, including but not limited to intellectual property rights, privacy rights, copyrights, trademark rights, proprietary rights or contractual rights;

4. violate any international, federal, provincial or state regulations, rules, laws or local ordinances;

5. use false, misleading or fraudulent personal information or content;

6. stalk, harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability, any user or visitor of the Site; 

7. use the content on the Site for any improper purpose;

8. collect or track the personal information of others; 

9. spam, phish, pretext, spider, crawl or scrape; or

10. interfere with or circumvent the security features of the Site or any related websites. We reserve the right to terminate your use of the Site, programs and/or services, or any related website for violating any of the prohibited uses.

You agree that you are responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Errors, Inaccuracies, and Omissions

The information provided on the Site and in the programs may contain inaccuracies, typographical errors or omissions that may relate to program and/or service descriptions, pricing, promotions, offers, and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Site, in the programs, or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We are not obligated to update, amend or clarify information on the Site, in the programs, or on any related website, including without limitation, pricing information, except as required by law. 

Disclaimer 

We make no claims about the medicinal value of specific products, programs and/or services on or through the Site. The statements made on the Site have not been evaluated by the FDA and Health Canada. You acknowledge that Kristin MacKinnon is not a Naturopath or Medical Doctor. While nutritional support can be an important complement to your medical care, you understand nutritional counselling is not a substitute for the diagnosis, treatment or care of disease by a medical doctor and that you should continue with regular medical supervision and care by your primary care physician. Any information provided by NUU GLO and Kristin MacKinnon on the Site and in the programs and/or services is not intended to diagnose, treat, cure or prevent any type of disease or condition. The information presented on the Site and in the programs and/or services is for educational purposes only. Products, programs, services, information and any other content relating to medical and health conditions provided on the Site directly or by linking to third-party websites are provided for information purposes only. The Site does not recommend self-management of health issues. By using the Site and the programs and/or services you agree to indemnify NUU GLO administrators and owners for any and all responsibility regarding your health and wellbeing.

The nutrition information provided by NUU GLO and Kristin MacKinnon is designed for, and is solely intended to be, suggestions which may be voluntarily implemented into your diet and lifestyle (or the diet and lifestyle of the client for which you are legally responsible). NUU GLO and Kristin MacKinnon are relying on the truth, accuracy, and completeness of all information which you have provided. Any recommendations you follow relating to the change of your diet and lifestyle, including the use of nutritional supplements, is completely voluntary and undertaken at your own risk.

You acknowledge that the information provided to you by NUU GLO and Kristin MacKinnon via NUU GLO’s programs and/or services is designed to meet your personal dietary and lifestyle needs. It is not suitable for any other individual and you agree not to transfer, copy or sell the programs or any information in the programs. 

No warranties or representations are being made to you regarding the results you will achieve from information on the Site and/or any wellness program designed by NUU GLO and Kristin MacKinnon. You understand that results are individual and may vary.

Our programs and/or services are designed to be beneficial and safe when used in the manner intended according to instructions. Your use of our programs and/or services is beyond our control, so it is your responsibility to determine the suitability of our programs and/or services and to use them appropriately and safely. We are not liable for incidences connected to the use or misuse of our programs.

Release of Liability

You agree (on behalf of yourself, your personal representatives, estate, heirs, next of kin and assigns) to release, covenant not to sue, discharge, indemnify, and hold harmless NUU GLO and Kristin MacKinnon, our agents, owners, volunteers, participants, service providers, licensors, employees, and all other persons or entities acting in any capacity on our behalf from any and all liability and any and all claims, demands and causes of action of any kind whatsoever (including, but not limited to injury, illness, allergic reaction, or lack of results) that you (or the client for which you are legally responsible) may have arising out of your (or the client for which you are legally responsible) use of the Site, and/or participation in any nutrition program developed by NUU GLO and Kristin MacKinnon, and/or the consumption by you (or the client for which you are legally responsible) of a product suggested or recommended by NUU GLO and Kristin MacKinnon, including as a result of negligence.

Because some jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Severability 

Unenforceability or invalidity of one or more clauses in this Agreement shall not have an effect on any other clause in this Agreement. If it is possible, any unenforceable or invalid clause in this Agreement shall be modified to show the original intention of the parties.

Termination

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use the Site, or our programs or services, or when you cease using the Site.

We may terminate your access to the Site, without cause or notice, if in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service. In the case of termination, you will still be liable for all amounts due up to and including the date of termination; and/or accordingly we may deny you access to our programs and services (or any part thereof).

Entire Agreement

Our Terms of Service and any policies posted by us on the Site, or in respect to the programs or services, constitutes the entire agreement, an understanding between you and us, and governs your use of the programs or services, superseding any prior agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Changes to Terms of Service

We reserve the right to change the Terms of Service at any time by posting the updated version to this page. It is your responsibility to check this page periodically for any changes or updates that may affect you. Your continued use of the Site after any changes to these terms will be regarded as acceptance of our Terms of Service. If you do not agree to the amendments, then you must cease using the Site, programs, and services.

Return, Exchange, and Refund Policy
